Taxes, explained simply

FIRPTA is a planning item, not a barrier

FIRPTA is the US federal law that applies when a foreign owner sells US real estate: a portion of the sale price is withheld at closing and sent to the IRS, and the final tax is settled through a tax filing. Standard withholding is fifteen percent of the sale price, with reduced or waived cases at lower price points when residence conditions are met. None of this should surprise you at the closing table, which is why we cover it before you buy.

At purchase

Buying is the easy side. You mainly plan ahead: how you hold title, what an ITIN is, and what your exit will look like years from now.

At sale

Withholding applies to the sale price, not the profit. Refunds are common once the actual tax is calculated on a US tax filing, and withholding certificates can reduce the amount held in some cases.
